1. Acceptance of Terms
By downloading, accessing, or using the Secure Authenticator OTP, MFA (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Use of the App
2.1 Eligibility
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
2.2 License
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
2.3 Prohibited Conduct
You agree not to:
Use the App for any illegal or unauthorized purpose.
Modify, adapt, hack, or reverse engineer the App.
Use the App to transmit any viruses or malicious code.
Violate any applicable laws or regulations in connection with your use of the App.
3. Account Registration
3.1 Account Creation
To access certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand how we collect, use, and protect your information.
If we receive a refund request for an in-app purchase from a user, we reserve the right to provide Apple with information regarding the user’s in-app purchase consumption. This includes the following data: time since the install, total app usage time, anonymous account identifier, whether the in-app purchase being refunded was fully consumed, whether the in-app purchase came with a trial period or not, the total amount spent, and the total amount refunded.
5. Intellectual Property
5.1 Ownership
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Secure Authenticator OTP, MFA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5.2 Trademarks
The Secure Authenticator OTP, MFA name and logo are trademarks of our company. You agree not to display or use these trademarks in any manner without our prior written permission.
6. Disclaimers and Limitation of Liability
6.1 Disclaimers
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free.
6.2 Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party; or (d) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available via the App.
7. Indemnification
You agree to indemnify, defend, and hold harmless Secure Authenticator OTP, MFA, its officers, directors, employees, agents, and third parties, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your infringement of any third-party rights.
8. Termination
We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
9. Changes to Terms
We reserve the right
to modify these Terms at any time. If we make material changes, we will notify you by email or through the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
